How’s it going fellow explorer? It appears you have discovered our terms of services page! Much like many of the wonderful experiences on our platform, these can be easily overlooked. However it is important that you understand what you can expect from us, what we expect from you, and factors that can impact your use of Perl services.

The Terms

1. Service Provider

Perl services are provided by, and you’re contracting with:

Organized under the laws of Ontario, Canada, and operating under the laws of Canada.

2. User

Users can be split into two different categories, consumers and experience providers (EPs). Consumers are those who are purchasing services provided by Perl; EPs are those who are offering their services through Perl products. “User(s)” refers to both consumers and EPs collectively.

3. Age Requirements

To use our services unsupervised, and attend any bookings alone, users should be at least 16 years old. If you are under this age, please have a parent or legal guardian read these terms and accompany you when using any of our services.

To use our services as an establishment or EP, you must be 18 or over, and show proof of being the owner or legal representative of their respective establishment.

If you’re a parent or legal guardian, and have allowed use of Perl’s services, all terms under this agreement are applicable to you, in addition to being responsible for your child’s activity on the services.

4. From Us to You

Whenever we use the terms “Perl”, “we”, “us”, and “our”, we are solely referring to Perl Experiences Inc.. When you agree and follow these terms, we give you permission to use the full range of our services that currently come in the form of a site and in future, an app.

Our services require users to create an account. In the process of which, we collect names and emails. The collected information will not be used for any purposes other than identifying you as the rightful owner of any bookings made and managed. Further, we may use third parties such as Google Analytics, which may independently handle and collect publicly available information. We do not control how these third parties use or handle your data.

5. Modifications to Terms

We reserve the right, in our sole discretion, to modify these Terms periodically. When this happens, we will update the “Last Updated” date above. You will be notified of any changes to these terms upon said changes coming into effect. By continuing to use our services after the effective date of any changes will serve as your acceptance of the changed terms. Any disputes that arise will be resolved with the terms in effect at the time of dispute. If you disagree with any of the changes made to the terms, please discontinue use of any of our services immediately.

6. Modifications to Services

We reserve the right, in our sole discretion, to modify or discontinue, temporarily or permanently, in full or in part, the Site without any notice. We will not be liable to you, or any third party, for any discontinuance, modification, or suspension of any Perl products.

7. Proprietary Rights

We own all intellectual property and rights in our services, including (but not limited to) software, text, images, trademarks, service marks, designs, and logos. Our intellectual property is protected by applicable intellectual property laws and international treaties. EPs who have provided their own images and videos to the site agree to grant permission to us to use the aforementioned media in promotional content, up to and including 6 months after the termination of using our services, unless otherwise specified by respective EPs. Termination here specifically refers to the permanent deletion of an EP’s account.

8. Indemnity

You agree to hold and indemnify us and our employees, directors, affiliates, and contractors harmless from any liability, damages, costs, claims, and expenses incurred from your use of our products, violation of the terms of service, violation of a third party through the use and content of any of our services.

9. Whole Agreement

These terms are the entire and exclusive agreement between you and us regarding the use of our services. The terms supersede any prior or contemporaneous agreements, written or oral, understandings, and other forms of communication relating to the contents with which the terms are concerned.
